Terms of Service

1. Parties and Eligibility

These Terms are between you and SignalScan Inc. You must be at least 18 years old and authorized to bind your organization (if applicable).

2. Service Description

SignalScan provides automated technical scans, remediation guidance, and optional launch-automation workflows. Outputs are informational and operational tools, not legal, tax, financial, or security certification.

3. Account and Acceptable Use

• You are responsible for account credentials and all activity under your account.
• You must have permission to scan domains, APIs, and services you submit.
• You may not use the service for unlawful activity, abuse, or unauthorized access attempts.
• You may not reverse engineer or misuse the platform to bypass limits or pricing.

4. Scan and Launch Engine Limitations

• Scan and launch results are generated automatically and may contain inaccuracies, omissions, or outdated assumptions.
• We do not guarantee correctness, completeness, fitness for a specific purpose, or uninterrupted operation.
• You are solely responsible for reviewing, testing, and validating all generated code, configuration, and launch actions before production use.
• We do not guarantee acceptance by third-party directories, platforms, search engines, or external providers.

5. Third-Party Services

SignalScan integrates with third-party services (including hosting, DNS, payment, and directory platforms). Their availability, terms, and policies are outside our control. We are not liable for third-party outages, policy changes, suspensions, or data handling.

6. Pricing, Billing, and LemonSqueezy

• Paid features require valid payment through LemonSqueezy checkout.
• LemonSqueezy may act as merchant of record and may handle payment processing, taxes, invoicing, refunds, and chargebacks under its own terms.
• You authorize charges applicable to your selected plan and jurisdiction. Taxes/VAT may apply based on billing location.
• Billing disputes, payment instrument issues, and chargeback workflows may require direct coordination with LemonSqueezy and/or your payment provider.

7. Plan Terms, Renewals, and Cancellation

• Plan details, included usage, and final pricing are shown at checkout before you pay.
• Unless checkout explicitly states recurring billing, purchases are one-time payments.
• If a recurring plan is offered, it renews automatically until canceled through LemonSqueezy or any supported billing portal.
• Cancellation stops the next billing period and does not retroactively cancel completed periods.

8. Refunds and Statutory Withdrawal Rights

Unless otherwise required by mandatory law, refunds are handled according to the active commercial policy shown at checkout and the applicable LemonSqueezy transaction terms.

If you are a consumer in the EEA or UK, you may have statutory withdrawal rights for distance contracts. If you request immediate delivery of paid digital services, you expressly consent to performance beginning during the withdrawal period and acknowledge that withdrawal rights may be reduced or lost as permitted by applicable law.

9. Intellectual Property

SignalScan and all related software, branding, and content are owned by SignalScan or its licensors. You retain rights in your submitted data and grant us the rights needed to host, process, and use that data to provide, secure, and improve the service.

10. Service Availability and Changes

We may update, modify, or discontinue features from time to time. We may also perform scheduled or emergency maintenance that temporarily affects availability. We are not liable for downtime caused by maintenance, third-party failures, force majeure events, or events outside our reasonable control.

11. Disclaimer of Warranties

To the maximum extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind (express, implied, statutory, or otherwise), including merchantability, fitness for a particular purpose, non-infringement, or error-free performance.

12. Limitation of Liability

To the maximum extent permitted by law, SignalScan will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, or business interruption.

Our aggregate liability for all claims relating to the service will not exceed the total amount you paid to SignalScan for the relevant service in the twelve (12) months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the fullest extent permitted by applicable law.

13. Indemnification

You agree to defend, indemnify, and hold harmless SignalScan from claims, losses, liabilities, and expenses arising from your misuse of the service, violation of these Terms, or infringement of third-party rights.

14. Suspension and Termination

We may suspend or terminate access for security, legal, or policy reasons, including abuse or non-payment. You may stop using the service at any time.

After termination, your access to paid features can end immediately. We may retain or delete account and service data in line with our Privacy Policy and legal obligations. Any fees already due remain payable.

15. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules, except where mandatory consumer protection law requires otherwise.

Unless mandatory law provides otherwise, disputes will be submitted to the competent courts in the Netherlands.

16. Changes to Terms

We may update these Terms from time to time. Material changes will be posted with an updated effective date. Continued use after changes means acceptance of the updated Terms.
